TailsMart Terms and Conditions

1. Acceptance of Terms 1.1 Welcome to TailsMart! These Terms and Conditions ("Terms") govern your use of the TailsMart mobile application (the "App") and any related services provided by TailsMart (collectively referred to as the "Services"). By accessing or using the App or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App or Services.

2. Account Registration 2.1 In order to use certain features of the App and Services, you may need to create a user account. You must provide accurate, complete, and up-to-date information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Pet Products and Services 3.1 TailsMart provides an online platform for the purchase and sale of pet products and related services. The products and services offered on the App are provided by third-party vendors. TailsMart does not directly sell or manufacture the products and is not responsible for their quality, safety, or compliance with any applicable laws or regulations. 3.2 TailsMart strives to provide accurate and up-to-date information about the pet products available on the App. However, TailsMart does not warrant the accuracy, completeness, or reliability of any product descriptions, prices, or other information displayed on the App. Any reliance on such information is at your own risk.

4. Ordering and Delivery 4.1 When placing an order through the App, you agree to provide accurate and complete information, including the delivery address. TailsMart will make reasonable efforts to ensure the timely delivery of the ordered products, but cannot guarantee specific delivery times. 4.2 In the event of any issues or discrepancies with your order, please contact TailsMart's customer support within a reasonable timeframe for assistance.

5. User Obligations and Conduct 5.1 You agree to use the App and Services only for lawful purposes and in compliance with these Terms. You will not engage in any activities that may:

5.1.1 Violate any applicable laws, regulations, or third-party rights; 5.1.2 Infringe upon the intellectual property rights of others; 5.1.3 Interfere with or disrupt the operation of the App or Services; 5.1.4 Transmit any harmful or malicious code or content; 5.1.5 Attempt to gain unauthorized access to any portion of the App, Services, or related systems.

1. Intellectual Property Rights 6.1 The App and Services, including all content and materials provided therein, are protected by intellectual property laws. You agree not to reproduce, modify, distribute, or create derivative works based on the App or Services without prior written permission from TailsMart. 6.2 You retain any intellectual property rights that you hold in content you submit or post through the App. By submitting or posting such content, you grant TailsMart a non-exclusive, worldwide, royalty-free, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with the operation and promotion of the App and Services.

2. Limitation of Liability 7.1 TailsMart shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App or Services, even if TailsMart has been advised of the possibility of such damages. This limitation of liability applies to the fullest extent permitted by law. 7.2 TailsMart's total liability for any claims arising under or related to these Terms shall not exceed the amount paid by you, if any, for using the App or Services during the six-month period preceding the claim.

3. Indemnification 8.1 You agree to indemnify and hold TailsMart and its affiliates, officers, directors, employees, and agents harmless from any claims, demands, losses, liabilities, costs, or expenses, including reasonable attorneys' fees, arising out of or in connection with:

8.1.1 Your use of the App or Services; 8.1.2 Your violation of these Terms; 8.1.3 Your violation of any applicable laws, regulations, or third-party rights.

1. Termination 9.1 TailsMart reserves the right to suspend or terminate your access to the App or Services at any time, without prior notice, for any reason or no reason at all. Upon termination, these Terms will continue to apply to any previous use of the App or Services.

2. Governing Law and Jurisdiction 10.1 These Terms shall be governed by and construed in accordance with the laws of India, with the jurisdiction of the courts in Bangalore, Karnataka, India. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

3. Modifications to Terms and Conditions 11.1 TailsMart reserves the right to modify or update these Terms at any time. Any changes will be effective upon posting the revised version on the App. Continued use of the App or Services after any such changes constitutes your acceptance of the revised Terms.
